Terms of Service

1. Acceptance of the terms

By downloading, installing or using JumpTracker ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

2. Description of the service

JumpTracker is an Apple Watch and iPhone sports tracking app dedicated to kitesurfing. It records your sessions from the Apple Watch (GPS track, distance, speed, jump detection and measurement: height and hang time) and syncs them to your iPhone. The app also records the spot's weather conditions (wind, gusts, direction) at session time through the third-party service météorologique tiers service.

JumpTracker includes a community dimension: per-spot rankings ("podium"), a feed of published sessions ("spot feed") and rider profiles.

3. Account and rider profile

Some community features (session publishing, rankings, feed, comments) require creating an account and a rider profile. You agree to:

• Provide accurate information when creating your profile and keep it up to date.
• Keep your login credentials confidential.
• Not impersonate a third party or create an account for someone else without permission.

You are responsible for any activity carried out from your account.

4. Voluntary session publishing

Publishing a session to the spot feed and rankings is always voluntary: a recorded session is only published if you decide to publish it. Once published, a session (spot, date, jump measurements, weather conditions, optional photo, username) becomes publicly visible to other users of the app, in the feed and the spot rankings.

Before publishing, make sure your session content does not reveal anything you want to keep private.

You may attach photos to your published sessions. By publishing them, you grant JumpTracker a non-exclusive, worldwide, royalty-free license to host and display this content within the app, solely for the purpose of operating the service. You warrant that:

• You own the rights to the photos you publish.
• Your content does not infringe third-party rights (image rights, intellectual property, privacy).
• You will not publish unlawful, offensive, misleading or off-topic content.

We reserve the right to remove any content that violates these Terms.

7. Data collected

As part of the service, the app collects in particular: the GPS tracks of your sessions, jump measurements (height, hang time), session data (distance, speed, duration), spot weather conditions obtained through service météorologique tiers, your profile information and the photos you choose to publish. 8. Indicative measurements — not a safety instrument

The measurements provided by JumpTracker (jump height, hang time, speed, distance, weather) are computed from Apple Watch sensors and third-party services. They are indicative and provided for sports and recreational purposes only:

• We do not guarantee the accuracy, precision or completeness of the measurements.
• JumpTracker is not a certified measuring instrument nor a safety device, and must never be used to assess riding conditions or make safety decisions.
• Weather data comes from the third-party service météorologique tiers service and may differ from actual conditions on the water.

Kitesurfing involves risks. You remain the sole judge of the conditions and solely responsible for your safety, your equipment and compliance with local regulations.

9. Prohibited conduct

By using JumpTracker, you agree not to:

• Cheat the rankings — Manipulate, falsify or artificially generate session data to mislead the rankings or the community.
• Harm other users — Harass, impersonate or publish content that infringes on others.
• Reverse engineering — Decompile, disassemble or attempt to extract the source code of the app or its communication protocols.
• Intrusion attempts — Attempt to gain unauthorized access to our servers or other users' accounts, or exploit vulnerabilities in the service.
• Automated abuse — Use bots, scripts or automated tools to interact with the service in a way not intended by its design.

10. Intellectual property

All content, design, code and features of JumpTracker are the intellectual property of the JumpTracker developer and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute or create derivative works based on the app without prior written permission. You retain ownership of your own content (sessions, photos).

11. Disclaimers

JumpTracker is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that:

• The app will be available at all times without interruption.
• The measurements and data displayed will be 100% accurate or complete.
• The app will meet all your specific requirements.

12. Limitation of liability

To the fullest extent permitted by applicable law, JumpTracker and its developer shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, nor for any bodily injury or property damage related to the practice of kitesurfing, resulting from:

• Your use of, or inability to use, the app.
• Any decision made on the basis of the measurements or data displayed by the app.
• Any unauthorized access to or alteration of your data.
• Any interruption or termination of the service.

13. Termination

We reserve the right to suspend or terminate access to JumpTracker at any time, without notice, for any behavior we deem contrary to these Terms or harmful to other users, ourselves or third parties.

You may stop using JumpTracker at any time by uninstalling the app, and request deletion of your account and data from support (see section 5).

14. Governing law

These Terms are governed by and construed in accordance with French law, without regard to conflict of law provisions. Any dispute arising from these Terms or the use of JumpTracker shall be subject to the exclusive jurisdiction of the French courts.
